DEFINITIONS
“Buyer” means you the person who purchases the Goods from Us.
“Seller” means Cue Store Direct.
“Website” means the Sellers website www.snookerpoolcues.com.
“Delivery Address” means the address for delivery of the Goods to the Buyer, as given when an Order is placed.
“Goods” means any goods (including all components, parts and accessories) to be supplied by the Seller to the Buyer under these Conditions.
“Price” means the placing of an order with the Seller.
“Order” means the placing of an order with the Seller.
“Order Form” means the Seller's order form on which orders shall be accepted by the Seller for the supply of the Goods.
1. CONDITIONS:
1.1. No variation of these Conditions shall apply unless otherwise agreed in writing by or on behalf of a Director of Cue Store Direct. We reserve the right to amend and update these Terms and Conditions and this Website at any time without notice.
1.2 Please read through these Terms and Conditions carefully before placing an Order. When placing an order with us via the Website or telephone, you confirm that you have read and are agreeing to accept our Terms and Conditions.
1.3 You must be over the age of 18 years to place an Order and the Seller reserves the right not to accept an Order where we reasonably believe that you do not meet this requirement.
1.4 These Conditions constitute the whole agreement between the Seller and the Buyer and supersede any prior promises, representations, undertakings or implications whether written or oral.
1.5 Customer privacy and information is used lawfully and in accordance with the Data Protection Act 1998. Any personal information requested through our website is encrypted and protected using industry standard SSL security. Card payments are handled via a third party secure server that complies with the industry standard. Cue Store Direct does not hold, store or pass on any customer card details.
2. ACCEPTANCE AND CANCELLATION
2.1 Goods ordered from the Website will require you to read and accept this document before proceeding with your Order.
2.2 All goods remain the property of Cue Store Direct until payment has been made.
2.3 We will then send an automatic receipt of order to the email address the Buyer has provided.
2.4 All Goods are subject to availability. If the Goods ordered are unavailable we will contact you to advise of the date of availability or to discuss the supply of a suitable alternative item. Should you wish to cancel your Order at this point then you will be able to do so.
2.5 The Seller, having given written notification to the Buyer, has the right to cancel this contract at any time before the Goods are delivered. On giving such notice the seller shall repay to the buyer sums paid in respect of the price in a timely manner. The seller shall not be liable for any loss or damage arising from such cancellation.
2.6 The Buyer may cancel this contract at any time before the goods are delivered by giving written notice to the seller (via email or post). If notice of cancellation is given more than 48 hours before the due date of delivery, the buyer shall be liable to the seller for 25% of the price of the goods. If notice of cancellation is given after the goods have been shipped for delivery, the buyer shall be liable to the seller for the full price of the goods, together with any costs or damages of the seller arising from such cancellation.
2.7 No cancellation, alteration or suspension of an Order shall be valid or binding unless notified in writing to the Seller, and also agreed to in writing by us the Seller.
3. PRICE AND PAYMENT
3.1 All published prices, fees, charges, disbursements, expenses and other sums payable are inclusive of Value Added Tax unless otherwise stated.
3.2 The price of the Goods and delivery shall be the price confirmed at the payment stage, which will also be confirmed on your invoice.
3.3 Any invoice errors must be advised in writing or via e-mail by the Buyer to the Seller within 5 working days from date of invoice.
3.4 The cost of postage and packaging per item can be found at the checkout form on our Website. Please note that postage and packaging is mainly dependent on the size, weight and frailty of the Goods. If you have any specific delivery requirements then please contact us in advance of placing an Order.
3.5 Payment is taken by credit or debit card. We accept MasterCard, Visa, American Express, Solo, Delta or Maestro.
3.6 Payment details will be taken at the point of Order and will be processed once We have accepted Your Order. Payment will be processed via Our SSL’s secure payment system.
3.7 You undertake that all details you provide to us for the purpose of purchasing any Goods are correct, that there are sufficient funds or credit facilities to cover the cost of any Goods, and that You are over the age of 18 years. We reserve the right to obtain validation and verification of the authenticity of your credit card or debit card details before processing your Order.
4. DELIVERY
4.1 The Goods shall be delivered to the Delivery Address as set out in the Order Form, or to such other place of delivery as is agreed by the Seller in writing prior to delivery of the Goods.
4.2 Delivery will be deemed as successfully made once the Goods have arrived at the delivery address and signed for either by you or by someone at the delivery address on Your behalf. In the case of delivery to certain organisations such as places of work, the signature of any person authorised to accept delivery on behalf of the organisation will be accepted as proof of delivery.
4.3 The Buyer shall ensure that all arrangements necessary to take delivery of the goods whenever and wherever they are tendered for delivery are made. Unless otherwise determined by the Seller all deliveries will be carried out by a 1-person delivery, so that the buyer is required to procure that all necessary assistance is provided to the delivery driver in the removal and carrying of the goods from the vehicle to the buyers requested point of delivery.
4.4 We reserve the right to charge you postage and packaging and delivery expenses where deemed appropriate in accordance with the postage and packaging prices set out on Our Website from time to time.
4.5 Times for delivery of Goods may vary and are intended to be an estimate only. Please allow up to 14 days for delivery from date of payment. Approximate times for delivery of certain items can be found on the delivery section of the Website and note that in exceptional circumstances delivery can take up to 6 weeks.
4.6 All Goods are available for delivery in most places in mainland UK. Some postal addresses in the Channel Islands, Northern Ireland, Republic of Ireland Isle of Wight, Isle of Man, Cornwall, the Scottish Isles or Highlands and some remote areas of Great Britain may not be covered by our delivery services. If you live in one of these locations please contact us in advance of placing an Order so that we can advise you of availability and any additional charges incurred for delivery.
Non-EU customers are responsible for Import Duty/Tax in their respective countries. Unfortunately we cannot advise you what these costs will be - please consult your local customs office for more information.
4.7 We ensure Goods are in perfect condition at the time of dispatch our liability for the delivery of Goods in transit is limited to our couriers’ terms and conditions.
4.8 Once delivered all Goods are at the Buyer risk. Any non-delivery of Goods must be reported to us in writing within 14 days of the dispatch date.
4.9.1 The Buyer is responsible to inspect the Goods upon delivery and report any alleged defects, shortage in quantity, damage or failure to conform with the contract to us verbally or in writing within 2 days of Delivery. In the event of such circumstances the Seller has the right to inspect the goods, via photographic evidence or return of goods to Cue store direct within a reasonable time and provided the Goods have not been used. If the buyer fails to satisfy these conditions the goods shall be presumed free from any defect or damage and to be in accordance with the contract, the Buyer shall also be deemed to have accepted the goods.
4.9.2 If the buyer fulfills the conditions set out in 4.9.1 and the Seller is satisfied with the evidence proved then the Buyer will be refunded the cost of the Goods in question.
5. RETURNS
5.1 In order that the Buyer may return goods for what ever reason the buyer must contact Cue Store Direct in order to raise a returns invoice.
5.2 Please note that customers will be liable for all postage costs incurred by the Seller on goods that have been incorrectly ordered or not wanted.
5.3 Guidance on Returning Items to us within 14 days of original invoice date are as follows:
- Goods must be unused and in saleable condition including all original packaging, instructions and accessories
- Cues and Cue shafts must not be chalked or show signs of use
- Return in packaging supplied for ease of return
- It is the customer's responsibility to ensure that returned parcels reach us, proof of postage is not proof of delivery, we advise that you return the goods via a signed for or tracked method to ensure they arrive with us.
5.4 We reserve the right to charge up to the value of the goods being returned or to refuse a return if the goods are sent back USED.
6. DESCRIPTIONS/ DISCLAMIER
6.1 All sizes, measurements, drawings, descriptions, specifications, illustrations and advertising issued by the Seller and on the Website are an approximation and may vary slightly from the published details.
6.2 We work closely with manufactures to ensure that the information and product specifications are complete and accurate but are subject to the information provided to us. Your equipment should only be used in accordance with the manufacturers instructions. We reserve the right to adjust prices without prior notice.
6.3 You will be responsible for ensuring that all information complete and accurate when ordering from the Seller, and that there is sufficient access and room to enable their delivery and use on Your premises. You acknowledge and accept that the Seller will not be held responsible should this not be the case.
7. FORCE MAJEURE
7.1 We reserve the right to defer the date of delivery or to cancel the Contract or reduce the volume of the Goods ordered by You (without liability to You) if We are prevented from or delayed in the carrying on of Our business due to circumstances outside Our reasonable control including, without limitation, strike, lock-out or other industrial action (whether or not relating to either party’s workforce), terrorist activity, civil commotion, government action, acts of God, war or national emergency or other circumstances beyond Our reasonable control provided that, if the event in question continues for a continuous period in excess of three months then You shall be entitled to give notice in writing to terminate these Conditions and a full refund will be made.
